AT THE ACCIDENT SCENE...
Being in an auto accident is an upsetting experience, regardless of who is at fault. Even a minor accident can complicate your life and bring you lots of unwanted stress. The following tips will help you cope at the scene and in the next few days to follow.

What to do:

  1. Don’t leave the scene. Leaving the scene of an accident is a crime. No matter how much trouble you think you might get into, leaving the scene will get you more trouble. In Florida, leaving the scene of an accident is a felony and is punishable by a sentence of up to 15 years, depending on the severity of the injuries.
  2. Exchange information with the other party. You should exchange name address, phone driver license and insurance info. You should also take this time to take pictures of the accident site as well as the damage to both vehicles. If both parties’ accounts of the accident differ – and they usually do – photographs can be used as evidence in settling an insurance claim or pursuing legal action. And remember, even if you don’t plan to sue, there’s always a possibility that the other party will sue you. The time to protect yourself is now.
  3. Do not make any statements about the accident to the other party or any witnesses that may be present. Most importantly, do not take the blame or express responsibility for the accident, even if you believe it could be your fault. Even a casual comment could be used by someone else to claim that you knew you were at fault.
  4. Call the police and file a police report. This is an official record and it will be used by for many purposes. But remember not to take the blame for the accident; only give exact details to the officer.
  5. Seek medical attention. Often, injuries from an auto accident don’t become apparent until days or even weeks later. Sometimes there are serious internal injuries that can cause prolonged illness, or even death, but are not immediately apparent. A medical professional can evaluate your condition and begin treatment if necessary.
  6. Contact your insurance company right away - and I do stress yours only, not the other side. Regardless of who is at fault in the accident, your insurance company can help cover some of your medical expenses and lost wages. However, don’t make any statements to the other party’s insurance company – their job is to represent their insured client, not you.
  7. Carry an auto accident defense kit in a plastic bag in your glove compartment. It should include a copy of your registration and proof of insurance, emergency contact numbers a disposable camera, a ballpoint pen, a copy of the exchange of information form below, and a printed copy of this page.
